1. GENERAL AND SCOPE OF APPLICATION
1.1 Westwing operates an online store on the www.westwing.fr website.
1.2 To enter into a contract with regard to the available offers, you must be at least 18 years old.
1.3 In principle, goods are only sold in quantities that are considered customary for a household.
1.4 These T&Cs apply to all contracts concluded via the www.westwing.fr website, unless separate B2B T&Cs apply to professionals acting for purposes within the scope of their commercial, industrial, artisanal, liberal or agricultural activity.
1.5 Where (working) days are indicated as a deadline, these are all days of the week, with the exception of Saturdays, Sundays and public holidays.
2. USE OF THE WWW.WESTWING.FR SITE AND REGISTRATION
2.1 When you order goods, you are asked to provide personal data which is collected and processed in accordance with Westwing's privacy policy. Section 20 (protection of personal data) applies to this processing.
2.2 You are responsible for the completeness and accuracy of the data you provide. You are also required to update your data. If the data you provided when using the website changes, you must correct the information immediately so that it remains up to date and . In particular, technical processes must not be disrupted or manipulated. 2.7 Without prejudice to the rights granted to consumers by law, including the right of withdrawal detailed below in Article 12, Westwing reserves the right to protect its rights at its own discretion and, for example, issue warnings, refuse orders, limit the available means of payment, suspend or interrupt
3. CONTRACTING PARTIES, LANGUAGE AND CONCLUSION OF THE CONTRACT
3.1 The contracting party to the conclusion of contracts on the www.westwing.fr website is Westwing.
3.2 The www.westwing.fr website is operated in French. Contracts concluded through the website are concluded exclusively in French.
3.3 The offer of goods on the www.westwing.fr website is not a binding offer. The offer is to be understood as a non-binding invitation to submit a purchase offer (" invitatio ad offerendum "). Once the selected goods have been placed in the virtual shopping cart and the electronic ordering process has been completed, you make a legally binding contractual offer by placing an order for the goods in the virtual shopping cart by clicking on the "pay now" or "complete payment" button. 4. PRICES AND SHIPPING COSTS
4.1 Orders for goods on the website www.westwing.fr are subject to the prices indicated on the product detail page at the time of ordering (excluding obvious pricing errors). Prices are total prices including VAT and packaging. Shipping costs and, where applicable, costs for an additional assembly service (see Article 5) are added separately.
4.2 The prices of the Products in your virtual shopping basket will always correspond to the current price indicated on the product detail page. This means that the current price of the product may differ from the price at which you added the product to your virtual shopping basket. When you add a product to your virtual shopping basket, you are not reserving the price displayed at that time. The price of a product may increase or decrease between the time you add it to your virtual basket and the time you actually purchase it.
4.3 Shipping costs are charged separately for each order and are based on the price indicated on the product details page. They depend, among other things, on the size, weight and shipping method. The shipping method is at Westwing's discretion.
5. ASSEMBLY SERVICE
5.1 For some goods, assembly or installation at the desired location is offered as a separate additional service for a fee. It is available in almost all regions of France, with the exception of Martinique, Reunion and French Polynesia (hereinafter " assembly service "). If you need the assembly of the goods, you can order the assembly service by ticking the "Assembly service" field on the information page of the property, place the goods in the virtual shopping cart and complete the order by clicking on the "pay now" or "confirm payment" button. .Westwing does not guarantee that the goods can actually be assembled or fixed in the spaces that have been unilaterally provided for this purpose by the client. Westwing reserves the right not to offer the assembly service in individual cases, at its discretion. 5.2 Westwing may, at its option, perform the assembly service itself or have it performed by third parties (subcontractors) acting on behalf of Westwing. You do not have the right to choose a particular person to carry out the assembly service specifically ordered on the site.
5.3 If you have not already agreed on a delivery date via the appointment website, you will be contacted by Westwing or a Westwing subcontractor for an appointment after you have placed your order. For the provision of the assembly service, a suitable and easily accessible environment must be made available to the fitter, supported by reasonable cooperation on your part, if necessary (e.g. to allow access to the mounting location and to provide sufficient space for assembly).
5.4 Painting and upholstery work and/or electrical installations as well as wall and ceiling installations are excluded from the assembly service.
5.5 If you order the fitting service, you will have to pay an additional fee to the purchase price. The exact cost of this service will be communicated to you in advance of the time you place your order.
5.6 In the event of an order for an assembly service, the risk of accidental loss and damage to the goods will only pass to you after the completion of the assembly service and the delivery of the goods.
5.7 Westwing and its subcontractors are entitled to carry out a completion check after assembly and to retain visual documents of the successful completion of the assembly for internal documentation purposes.
6. WESTWING DESIGN SERVICES
6.1 Through Westwing Design Services, Westwing offers personalised interior design advice via the website www.westwing.fr (hereinafter “Westwing Design Service(s)” or “Service”). These Terms and Conditions apply to these services in principle, unless otherwise specified below.
6.2 The services are provided online via video chat or video conference with screen sharing, in one of Westwing’s offline stores (Stores | Westwing) or, in the case of Westwing Design Services Deluxe, partly on-site. You can find the specific Westwing Design Services offered in your country on the website.
6.3 The Services are provided by Westwing or a subcontractor of Westwing.
6.4 As part of the Westwing Design Services, you will receive a professional interior design concept based on the information you have provided, together with a personalised shopping list. The exact scope of services and the respective costs of the individual Westwing Design Services are listed on the website www.westwing.de in the Design Service section.
6.5 Westwing reserves the right to refuse the Westwing Design Services or their provision if you have provided incorrect information regarding the premises, or if you act in a manner that is unlawful, contrary to public policy or in breach of these Terms and Conditions.
6.6 Westwing reserves the right to cancel bookings for the provision of the service up to 12 hours before the appointment in cases for which Westwing is not responsible (e.g. force majeure) and will inform you in advance of any cancellation. In cases where an appointment is cancelled, you will be offered a new appointment or a refund if a new appointment cannot be arranged. You may also reschedule the agreed appointment free of charge up to 12 hours before the appointment. In this case, Westwing will offer you an alternative appointment subject to availability.
6.7 Upon completion of the final service provided as part of the booked Westwing Design Services, the contractual relationship for this specific Westwing Design Service shall automatically terminate. Should a redesign or reworking of the Westwing Design Services provided be required at your request, you must book a new Westwing Design Service via the website.
6.8 The copyright and other intellectual property rights relating to the interior design concepts and room concepts designed by Westwing and/or within the scope of the Westwing Design Services belong exclusively to Westwing. Westwing grants you simple, perpetual and non-transferable rights for personal use in respect of the services provided within the scope of the Westwing Design Services. Commercial or public use is permitted only with Westwing’s prior written consent. Westwing is entitled to use the results of the Westwing Design Services for advertising purposes (e.g. as design examples on the website) subject to your prior consent.
6.9 You are responsible for providing Westwing with information and documents (e.g. floor plans) that may be relevant to the provision of the service.
7. PAYMENT TERMS
7.1 You can pay for the goods – subject to a credit check in accordance with applicable law – using one of the following payment methods:
PayPal, credit/debit card (VISA, Mastercard, American Express), ApplePay, GooglePay (only when ordering via a web browser) and Klarna.
7.2 Westwing accepts various credit cards, currently: VISA, Mastercard and American Express. Westwing will charge the invoice amount to your credit card upon receipt of the order via our payment service provider Stripe Payments Europe Ltd (registered in the Irish Commercial Register under number 3206488LH).
7.3 ApplePay and GooglePay payment methods are processed by the payment service provider Stripe Payments Europe Ltd (registered in the Irish Commercial Register under number 32064LH).
7.4 If a payment method offered by PayPal is selected, the payment will be processed by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (registered in the commercial register under number R.C.S. Luxembourg B 118 349), subject to PayPal's terms of use, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full.
7.5 Westwing offers you, in collaboration with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden (registered in the Swedish Trade Register under number 556737-0431), the following payment options if you have a suitable credit card: purchase on account with payment within 30 days, payment in three instalments without interest. In this case, Westwing assigns its claim to Klarna.
8. INVOICING
8.1 By accepting the GTC, you agree that Westwing may send you invoices electronically or make them available to you electronically in accordance with Article 232 of Council Directive 2006/112/EC.
8.2 Please note that if your details are not correct in accordance with clause 2.2 at the time of ordering, we will no longer be able to issue a corrective invoice to correct your details after your order has been processed.
9. VOUCHERS
9.1 Westwing offers different types of vouchers: gift vouchers, promotional vouchers and compensation vouchers.
9.1.1 Gift vouchers
9.1.1.1 Gift vouchers are vouchers that can be purchased on the website www.westwing.fr and can only be used on the website www.westwing.fr, unless otherwise stated on the gift voucher. Gift vouchers will be sent to you by email after the order has been placed.
9.1.1.2 Gift vouchers and any remaining balance on gift vouchers can be used until the end of the third year following the year in which the gift voucher was purchased.
9.1.1.3 Gift vouchers can only be used to purchase goods and services and not to purchase other gift vouchers.
9.1.1.4 If the price of your order exceeds the credit of a gift voucher, you can pay the difference using the payment methods offered. If the price of your order is less than the credit of a gift voucher, you can use the remaining credit for your next order.
9.1.1.5 In the event of termination of an order contract - for whatever reason - the purchase price will be refunded by means of a gift voucher or a refund to any other means of payment used.
9.1.1.6 The gift voucher is transferable.
9.1.1.7 Lost gift vouchers, in particular stolen ones, are non-refundable. Westwing accepts no liability for the loss of gift vouchers (and associated codes).
9.1.2 Promotional vouchers (including referral vouchers)
9.1.2.1 Promotional vouchers are vouchers issued free of charge as part of advertising campaigns with a specific period of validity and cannot be purchased by you. Promotional vouchers can only be used on the website www.westwing.fr during the specified period, but not for shipping or assembly costs. Promotional vouchers may be subject to other individual conditions. These will be communicated to you in connection with the voucher.
9.1.2.2 Promotional vouchers received as a new customer following an invitation from a Westwing member ("refer-a-friend voucher") cannot be used if you already have an account with Westwing, as the voucher can only be used by new customers.
9.1.2.3 First registration or new customer vouchers, which you receive once when registering on the website www.westwing.fr, can only be used once per customer account.
9.1.2.4 Only one promotional voucher can be used per order. It is not possible to refund or credit the balance of a promotional voucher if the purchase value is less than the value of the voucher.
9.1.2.5 The promotional voucher is non-transferable, non-refundable and cannot be reused if you return the goods or services paid for in whole or in part with the voucher within the statutory right of withdrawal. In the event of a proportional return of the goods ordered, the value of the voucher will be distributed proportionally to the goods ordered, i.e. if individual items are returned, the voucher will be credited proportionally to the price of the returned goods and will expire proportionally to the value of the goods. 9.2 Westwing reserves the right, in the event of justified suspicion of fraud or other activities contrary to the law or the conditions in connection with the purchase or redemption of a voucher, to block the code of the voucher concerned (also temporarily) or to refuse redemption (also temporarily). In the latter case, you are entitled to cancel the order.
9.3 Payment of the voucher amount is not possible, nor is a transfer of value or subsequent settlement for purchases already made, i.e. before the end of the order process.
9.4 The above-mentioned vouchers may only be used by consumers.
10. DELIVERY AND SHIPPING CONDITIONS
10.1 Deliveries will only be made in the United Kingdom (excluding Northern Ireland) to the delivery address you have provided.
10.2 The standard delivery times will be communicated to you on the page of the item concerned.
10.3 The goods ordered are sent by parcel or carrier, at Westwing's discretion.
10.4 Westwing does not guarantee delivery, as it is only obliged to deliver from its existing stock or from the delivery of goods ordered from suppliers. Westwing's delivery obligation does not apply if, despite an existing hedging transaction with the relevant supplier, Westwing does not receive, does not receive in full or does not receive on time the expected deliveries from its suppliers. In this case, Westwing will inform you immediately. Any sums paid, which by mutual agreement constitute advance payments, will be refunded by Westwing, on the understanding that you are in any case entitled to the rights set out in Articles L.216-1 et seq. of the French Consumer Code (suspension of payment, termination of the contract after formal notice to deliver within thirty days has been given and has not been complied with).
10.5 Westwing shall not be liable for the non-performance or inadequate performance of the obligations assumed by Westwing under this contract if and to the extent that this is due to the occurrence of a case of force majeure, without prejudice to Westwing's efforts to limit the consequences of such an event as far as possible.
Force majeure means one or more unforeseen events which, even if foreseeable, are beyond Westwing's control and whose effect on the performance of the contract could not have been prevented by reasonable efforts on the part of Westwing. This includes, but is not limited to, war, warlike conditions, insurrection, rebellion, military or civil coup, riot, embargo, government order, fire, flood, storm, hurricane or other severe weather conditions on a catastrophic scale, earthquake, lightning, pandemic, epidemic, nuclear risk or any other similar cause beyond Westwing's control that renders the performance or fulfilment of obligations under these GTC illegal, impossible or commercially impracticable. If a case of force majeure occurs, Westwing shall notify you as soon as possible. Westwing shall be released from its obligation to perform for the duration of the event. Delivery and performance deadlines shall be extended accordingly. If the force majeure event lasts longer than 8 weeks, Westwing and you shall be entitled to terminate the contract.
10.6 If delivery of the goods fails for reasons attributable to you, Westwing will charge you the cost of a new delivery as well as reasonable storage costs from the day of the failed delivery. You will also be charged for the cost of a new delivery if the first delivery was free of charge for you. We will inform you of the additional costs before the new delivery and will only make the delivery with your consent. Please note that refusal to accept delivery does not constitute an effective exercise of your right of withdrawal, which must be expressly declared to Westwing. Westwing reserves the right to terminate the contract if you do not accept a new delivery within 7 days. In this case, Westwing will refund any payments already made. The same applies if you effectively exercise your right of withdrawal. In this case, the shipping costs (standard shipping) will also be refunded to you.
11. WARRANTIES, LIABILITIES AND DAMAGE DUE TO TRANSPORTATION
11.1. Legal guarantee of conformity
Westwing is liable to you for any lack of conformity of the goods with the order. Westwing is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been made its responsibility by the contract or has been carried out under its responsibility, or when the incorrect installation is due to deficiencies or errors in the installation instructions provided by Westwing.
Any lack of conformity which becomes apparent within twenty-four months of delivery of the goods shall be presumed to have existed at the time of delivery (twelve months for second-hand goods), unless Westwing proves otherwise.
In the event of a lack of conformity, you are entitled to have the goods brought into conformity by repair or replacement or, failing that, to a reduction in the price or termination of the contract. You also have the right to suspend payment of all or part of the price or the delivery of the benefit provided for in the contract until Westwing has fulfilled its obligations.
The main articles of the Consumer Code describing the legal warranty against eviction are reproduced in Appendix 1 (Articles L. 217-1 et seq.).
11.2. Legal warranty against hidden defects
Westwing is liable to you for any hidden defects affecting a product, under the conditions set out in Articles 1641 to 1648 of the Civil Code. Any action resulting from a hidden defect must be brought within two years of the discovery of the defect, in accordance with Article 1648 of the Civil Code.
The articles of the Civil Code describing the legal warranty for hidden defects are reproduced in Appendix 1 (Articles 1641 et seq.).
11.3 Without prejudice to the content of Articles 10.1 and 10.2, Westwing shall only be liable for direct, certain, foreseeable and proven damage, to the exclusion of all indirect damage.
11.4 If the goods are delivered with packaging or contents that are clearly damaged, please report this immediately to the delivery company concerned and contact Westwing's customer service (service@westwing.fr). This report does not affect your warranty rights, but enables Westwing to more easily assert its rights against the delivery company.
12. COMMERCIAL WARRANTY
An additional commercial guarantee only exists if it is explicitly stated and described on the detail page of the property.
13. RIGHT OF WITHDRAWAL FOR CONSUMERS
You have the right to exercise a right of withdrawal from an order with Westwing within fourteen (14) days without giving reasons. This period starts from: (i) the delivery of the goods, or (ii) in the case of an order for several goods delivered separately or an order for goods consisting of lots or multiple parts whose delivery is spread over a defined period, from the delivery of the last goods in the order, or (iii) for contracts for the provision of services, from the conclusion of the contract.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by a clear statement (e.g. by letter sent by post or e-mail). You can use the following model withdrawal form, which is not mandatory:

14. CONSEQUENCES OF WITHDRAWAL
If you have exercised your right of withdrawal, we will refund all payments received from you, including delivery costs, without delay and at the latest within fourteen (14) days from the date on which we received the notice of withdrawal. For the refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you. Under no circumstances will any fees be charged for this refund. We may refuse a refund until we have received the goods or you have provided proof that you have returned the goods, whichever is earlier.
You must return the goods within fourteen (14) days from the day on which you informed us of your withdrawal, in suitable packaging to ensure the reasonable preservation of the goods, to the following address:

The deadline is met if you send the goods before the 14-day deadline. Return shipping costs are at our expense. 15. VOLUNTARY RIGHT OF RETURN FOR CONSUMERS
15.1 For all purchases of goods, Westwing grants you a voluntary right of return for a total of 30 days from receipt of the goods, regardless of the statutory right of withdrawal provided for in Article 13. This voluntary right of return allows you to withdraw from the sales contract even after the expiry of the statutory withdrawal period of 14 days (see Article 13) by returning the goods to Westwing within 30 days of receipt.
The exercise of the right of voluntary return is, however, subject to the condition that the goods are returned complete, in perfect condition and undamaged in their original sales packaging. If this is not the case, Westwing reserves the right to refuse the return. Please note that the risk and cost of return shipping are your responsibility when returning goods under the voluntary right of return. The voluntary right of return does not apply to the purchase of gift vouchers.
15.2 The refund will be credited to the payment method you used for payment. If direct debit was chosen as the payment method, you must not object to the direct debit without a legitimate reason.
15.3 Your statutory right of withdrawal (see Section 13) is not affected by compliance with the requirements set out in this Section 14 and continues to apply independently of them. Until the expiry of the statutory withdrawal period, only the statutory conditions mentioned therein apply. This voluntary right of return granted to you by Westwing does not limit your statutory rights, in particular your right of withdrawal.
16. REIMBURSEMENT OF DELIVERY AND SERVICE COSTS IN THE EVENT OF PARTIAL WITHDRAWAL OR PARTIAL VOLUNTARY RETURN
If you exercise your right of withdrawal or right of voluntary return for only part of the goods in an order, Westwing will refund the payments made for the goods to which your notification relates, including the costs of initial delivery and assembly (if not yet fitted). However, if the delivery and assembly costs (or part of them) would also have been incurred in full if you had only ordered the goods for which you did not exercise a right of withdrawal or a voluntary right of return, these will be excluded from the refund.
17. RETENTION OF TITLE
The property remains the property of Westwing until paid in full.

19. EXCLUSIONS OF LIABILITY FOR LINKS

The provider or operator of these third-party pages is always responsible for their content.
